O-licence revoked after director’s son admits to driving without tacho

Traffic commissioner (TC) for Wales Nick Jones (pictured) has revoked the O-licence of family-run home removals business Tony’s Removals after the son of its boss admitted driving without a tachograph chart.

At a November public inquiry in Welshpool, Anthony Defrond – who ran the Pentre-based business authorised for two vehicles – heard how his son, Daniel Defrond, was stopped on 16 November 2012 by Vosa officers.  A traffic examiner identified breaches of drivers’ hours rules and a further examination of paperwork produced by Anthony revealed that 787km could not be accounted for in his son’s driving records. Daniel later admitted driving on two occasions without a tachograph chart.

Although the firm’s nominated transport manager Malcolm Pashley did visit the operation each month, no one had been checking or analysing drivers’ records at the business. TC Jones also heard that the operator had failed to satisfy financial standing requirements.

The TC suspended Daniel’s LGV driving licence for two weeks, from 1 to 14 December, and disqualified Pashley from acting as a transport manager. He said road safety and compliance with the law must always take priority over commercial considerations.
