O-licence denied after director fails to disclose financial history

Traffic commissioner (TC) for Scotland Joan AItken has turned down a licence application by Insch-based operator RJ Young Contracts after it failed to disclose its company and financial history.

In a written decision following an August public inquiry in Edinburgh, the TC told company director Ronald Young that she could not grant him permission to run two vehicles and two trailers at his plant hire business because he had “sought to hide” the pending liquidation of his previous business.

RJ Young Contracts had also failed to declare the company’s other director on its application for an O-licence. TC Aitken was told how there had been a petition lodged at Aberdeen Sheriff Court on or before 8 April this year for the liquidation of previous business RJ Plant Contractors, with the first report to creditors showing a debt of just over £690,000.

The TC said: “I cannot be benign about the failure to disclose the insolvency at the time of application and to disclose the existence of the other director.

“These application forms are important documents with warnings on them as to the need for accuracy.”
